The Los Angeles Daily News, is reporting that the window of former WWE Superstar Shad Gaspard filed court papers Monday against the state of California, Los Angeles County and the city of Los Angeles, alleging negligence and dangerous condition of public property.
The report also states that Siliana Gaspard alleges there were insufficient signs warning of the dangers of swimming there, that lifeguards who tried to rescue her husband and his 10-year-old son near the 4200 block of S. Ocean Front Walk were understaffed and not properly trained, and that they did not bring the proper equipment. She further alleges in her suit the rescuers assisted the boy, but “left Shad Gaspard in the water to die.”
In addition, the report indicates the plaintiff brought the still unofficial lawsuit in Los Angeles Superior Court on behalf of herself and Gaspard’s son, identified in her court papers only as A.G., and is seeking unspecified damages and burial costs.
A representative for the state could not be immediately reached.
Back in May, Gaspard and his family were at Venice Beach. He and his 10-year-old son were swimming when a riptide pulled them with other swimmers, out into the ocean. A rescue effort immediately went underway. Gaspard demanded lifeguards save his son first, which they did. As they went back for him, a large wave struck him and he was not seen again.
Divers and helicopters combed the area in search of Gaspard, but he was not located. The search effort was called off by the United States Coast Guard on Tuesday.
Gaspard was a member of the popular tag team Cryme Tyme. He was with WWE from 2006 to 2010, though he and his partner JTG were briefly released in 2007.
